Building Permits: How do I get one?

The building permit process can be daunting for some, which is why we have outlined the importance of building permits and how to obtain a building permit.

What is a building permit?

A building permit is a document that verifies that the proposed building satisfies The Building Act 1993 and Building Regulations 2018. A building permit is required for most new buildings and any major renovations or alterations to a building. It is needed for all commercial buildings. The building permit is generally issued within 5-10 working days.

Why do you need a building permit?

Building permits are necessary because they ensure that:

  • The building practitioners are registered and carry correct insurance
  • The appropriate documentation is prepared so that construction can be actioned properly and in relation to building legislation 
  • Key stages of the works are inspected and meet the necessary building regulations
  • The building is suitable to be occupied
Applying for a building permit

A registered building surveyor must be appointed before applying for a building permit. A building surveyor ensures that the building complies with legal requirements, and will apply for the building permit for you. The relevant building surveyor also carries out inspections throughout the construction process to ensure the building work is being undertaken correctly and are meeting the necessary building regulations. Once the work is completed, the building surveyor will issue either an Occupancy Permit or Certificate of Final Inspection if required.

Alternatively, your architect or builder can also apply for a building permit. However, they must first be authorized by you in writing to make the application on your behalf.

To apply for a building permit, it is necessary that:

  • At least three copies of drawings, specifications, plans are submitted with the application form.  
  • The building permit levy is paid. This is calculated based off the cost of the works to be done. A building permit will only be issued once the levy is paid.

Should you realize that the works may not be completed under these time constraints, you must request an extension from the relevant building surveyor before the permit lapses. The relevant building surveyor may extend the date if they deem an extension is warranted. If building works continue after the lapsed time, it is considered illegal.
